In breve
Regola la vendita di 10+ lotti: i costruttori devono ottenere licenza, realizzare infrastrutture e cedere le aree comuni ai residenti.
8: Powers and duties of the Central Land Development Commission
The Central Commission oversees land subdivision nationwide. It sets policy, issues general rules, approves the local conditions proposed by provincial bodies, drafts the model sale agreement that licence applicants must use, resolves disputed questions raised by applicants or licensed developers, and handles other tasks assigned by law. Its rules take effect once printed in the Government Gazette.
9: Term of office of appointed members
Members appointed for their expertise serve for two years. They may be appointed again after their term ends, but nobody may hold the post for more than two terms in a row.
10: Grounds for ending membership
Besides the end of the term, an appointed member leaves the post on death, resignation, removal by the Minister for misconduct, corruption, dishonesty or incompetence, bankruptcy, being declared legally incapacitated or partly incapacitated, or a final prison sentence, except for negligent or minor offences.
11: Replacement of a member who leaves early
If an appointed member leaves before the term ends, the Minister may name a successor. The successor serves only for the time remaining in the predecessor's term.
12: Meetings, quorum and voting of the Central Commission
A meeting needs at least half of the sitting members present. If the Chairman is absent or unable to act, those present choose a chair from among themselves. Decisions pass by majority, each member having one vote, and the presiding member has a further casting vote in a tie.
13: Composition of Bangkok and provincial commissions
Each province has its own commission. In Bangkok it is chaired by the Director-General of the Lands Department or a deputy and includes officials from prosecution, city administration, planning, irrigation and environment bodies, plus four outside experts. Elsewhere the governor or deputy chairs, with local officials and four experts. Affected local authorities add a representative. Experts must not be land developers.
14: Powers and duties of the provincial commission
The commission supervises subdivision within its province to ensure compliance with the Act. It issues local conditions, subject to central approval, reviews licence applications and decides on licence transfers or revocation of a transfer, inspects projects against the approved plan and procedure, and performs other statutory tasks. Its conditions become effective upon Gazette publication.
15: Power to summon persons and request documents
When carrying out their functions, the Central Commission and provincial commissions may send written summonses requiring any person to give factual statements, explanations, opinions or technical advice, or to provide documents and information relating to a subdivision project or related matters, as they consider appropriate.
16: Content of local subdivision conditions
Local conditions must set rules for the plan, project and procedure, serving public health, environment, traffic, safety, amenities and town planning, and fitting local circumstances. They must fix minimum plot dimensions or area, road and path standards and links to outside roads, drainage, wastewater and refuse systems, and standards for shared facilities and community services.
