Section 8: Powers of the Central Land Development Commission
This body sets overall policy on land development, adopts binding rules, approves provincial stipulations, creates a standard sale-and-purchase contract form for developers, and rules on disputes raised by applicants or developers. Its rules take legal effect only after gazette publication.
Section 9: Term of Qualified Members
Appointed expert members serve two-year terms and may be reappointed, but never for more than two terms running consecutively, ensuring periodic renewal of independent expertise on the commission.
Section 10: Early Vacation of Office
A qualified member loses their seat early upon death, resignation, dismissal by the Minister for misconduct or incompetence, bankruptcy, incapacity or quasi-incapacity, or a final criminal conviction (excluding negligence or minor offences).
Section 11: Replacement Member
If a qualified member departs before their term ends, the Minister may appoint a replacement, who then serves only for the remainder of the original member's unexpired term.
Section 12: Quorum and Voting Procedure
Meetings require at least half of current members present. Absent the Chairman, attendees elect a presiding member. Decisions pass by majority vote, one vote per member, with the presiding member casting the deciding vote on a tie.
Section 13: Provincial Land Development Commissions
Every province, including Bangkok, has its own commission combining senior officials from land, prosecution, planning, irrigation and environmental bodies together with appointed private-sector experts who are not themselves developers, plus a local government representative when relevant land falls within its area.
Section 14: Powers of the Provincial Commission
The provincial body enforces compliance within its territory: issuing local stipulations (subject to central approval), reviewing license applications and transfers, inspecting projects against approved plans, and handling other assigned matters. Stipulations become effective upon gazette publication.
Section 15: Power to Summon Information
Both the central and provincial commissions may formally request any person to provide factual statements, explanations, expert opinions, documents or data relevant to a land development matter, as needed for their functions.
Section 16: Content of Development Stipulations
Provincial stipulations must set standards for plot size, road and pathway systems and their connection to outside routes, drainage and waste treatment, and public facility standards, all tailored to local conditions and covering health, environment, traffic safety and community planning.
